Terms of Service

Overview. Karen’s Botanicals (“we,” “us”) operates this website and store (the “Services”), which is powered by Shopify. By using the Services, you agree to these Terms and our Privacy Policy If you don’t agree, please don’t use them.

1. Accounts. You must be of legal age in your state or province or have a parent or guardian’s consent. You agree to give us accurate, current information and to keep your account credentials secure. You’re responsible for all activity under your account.

2. Products, Orders and Pricing. Colors and appearance may vary by device, and we may change or discontinue products or limit quantities at any time. Placing an order is an offer to purchase, and we may accept or decline it. Orders are accepted only once we confirm them and process payment, and we may be unable to cancel afterward. Prices and promotions may change without notice, and you pay the price in effect when you order, plus any taxes, shipping and import charges. Purchases are for personal use, not for sale. Returns are governed by our Refund Policy.  If we make a pricing or listing error, we may correct it or cancel the order.

3. Shipping. Delivery times are estimates, not guarantees. We aren’t responsible for carrier or customs delays, and risk of loss passes to you once we hand the products to the carrier.

4. Intellectual Property. All content on the Services, including our names, logos, text, images and designs, belong to us or our licensors. You may use it for personal, non-commercial purposes only and may not copy or reuse it without our written permission.

5. Third-Party Tools. The Services may include third-party tools or link to third-party sites. We don’t control or endorse them and aren’t liable for them.

6. Relationship with Shopify. Karen’s Botanicals is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Karen’s Botanicals. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Karen’s Botanicals, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Karen’s Botanicals.

7. Privacy. Your personal information is handled under our Privacy Policy.  Because the Services are hosted by Shopify, Shopify and other third parties may also process your information.

8. Feedback. If you send us reviews, ideas or other feedback, you give us a perpetual, royalty-free license to use it for any purpose, including commercial use. You confirm that it’s yours to share and not violate anyone’s rights or contain anything unlawful or harmful.

9. Prohibited Uses. Use the Services for lawful purposes only. Don’t violate any law or anyone’s rights, send spam or false information, upload malicious code, scrape or resell our content, or interfere with our security. We may suspend or terminate your access if you violate these Terms.

10. Automated Agents. Any software acting on someone’s behalf (an “Agent”) may not use the Services if we’ve asked it not to, and we may block or limit Agents. Permitted Agents must identify themselves in their user agent string as “Agent/[agent name],” must not hide that they’re automated (including by mimicking human behavior or bypassing CAPTCHAs), must answer truthfully if asked whether they’re human, and must not circumvent our access controls.

11. Termination. We may end your access at any time without notice. Provisions that by nature should survive (such as intellectual property, disclaimers, liability limits, indemnification and governing law) will remain in effect.

12. Disclaimers and Limitation of Liability. The Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. To the same extent, Karen’s Botanicals, its affiliates, personnel and licensors, and Shopify and its affiliates, are not liable for any injury, loss or damages (direct, indirect, incidental or consequential, including lost profits or data) arising from your use of the Services or any products, however caused. Some jurisdictions don’t allow certain disclaimers, so parts of this section may not apply to you.

13. Indemnification. You agree to defend and hold harmless Karen’s Botanicals, Shopify and our affiliates and personnel from claims, losses and legal fees arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

14. General. If any provision is unenforceable, the rest stays in effect. Our not enforcing a right isn’t a waiver of it. These Terms and our posted policies are the entire agreement between us. You may not assign these Terms; we may. These Terms are governed by the laws of the state where we’re headquartered, and its state and federal courts have jurisdiction.

15. Changes. We may update these Terms by posting changes on our website. Continued use of the Services means you accept them.
